1. Acceptance of Terms
EMR Design Studio provides web and graphic design services. By purchasing any services from EMR Design Studio, you agree to the Terms of Service (“TOS”) and policies as stated below. TOS & Policies are subject to change from time to time without notice.
2. Business Hours
Monday – Thursday
09:00am – 2:00pm
(Fridays are usually my focused administrative days)
Closed weekends and national holidays
3. Proposal
The terms of the proposal will be honored for 15 days from the date issued. After the 15 days, a new proposal will be provided upon request.
4. Deposits
4.1 Web design:Payment in full required for purchases under $400. A non-refundable 50% deposit is required to add your name to the waiting list. The remaining balance and any additional charges are due one (1) week before your scheduled installation date.
4.2 All other services:All other products (logos, social media, print, illustrations, etc) must be paid in full before the project is commenced.
5. Payment
EMR Design Studio accepts credit cards and debit cards payments through PayPal. You do not need a PayPal account to checkout. Your credit card and/or banking information is never stored on our website, we use PayPal and/or Stripe to securely process transactions and are never in possession of your credit card or bank information.
If the invoice is not paid within three days of the invoice being sent, the proposal agreement becomes null & void and the client will no longer hold a spot in the design queue.
6. Refunds
Due to the nature of the graphic design process and the time involved, EMR Design Studio will not issue any refunds or accept returns for any reason.
7. Cancellation Policy
Cancellations made more than 30 days prior to the starting date can be rescheduled at the end of the current waiting list. Cancellations made within 30 days or less or after the project has been started will lose the deposit in full. No exceptions.
8. Revisions
You are allowed three (3) major rounds of revisions* for a web design. If you should exceed this amount, a fee of $75 an hour will occur (1-hour minimum). *Limited or no revisions apply to Basic Install.
9. Timeframe & Completion
EMR Design Studio will provide you with an estimated time of delivery for the design. Generally, you can expect a draft within a week from the day the project has begun. Once the project is started, you must check email frequently. Failure to respond in a timely manner (5 business days) may result in the design being put on hold.
10. Communication
All communication shall be done via email. No business will be conducted by phone. The design brief should be completed before the specified start date or the project will be recycled back into the queue. Design brief must be received within 36 hours to avoid any delays.
In the event EMR Design Studio is unable to reach you within 15 days, all monies will be forfeited to EMR Design Studio and the project will be canceled without notification.
11. Authorization & Privacy
You agree to provide EMR Design Studio access usernames and passwords to any hosting, domain account, add as admin to Facebook business page or blog account for installing and updating the web products as needed. Privacy is very important to me. Rest assured, this information will always be kept confidential and will not be shared with anyone. It will only be used for the purpose of completing your project.
12. Credit and Copyright
All blog, web, print and graphic designs created by EMR Design Studio remain my personal property, and I retain the copyright. You own the copyright to your website content. As the client, you will be assigned the right to use the design on your website after the project is completed. A credit linking back to EMR Design Studio will be placed in your footer and must remain intact as long as my design is present on your blog or website. It can be removed for a fee.
I reserve the right to use your design in my portfolio and for other promotional purposes. All graphics and design work should not be used for any other purpose than what was originally agreed upon. If you wish to use any graphics from your design for any other purpose please contact me first. I remain the exclusive license holder of all graphics and have the right to resell as I please.
You may not make changes to your logo unless approved by me; logo must be used as it was given to you. The logo must be used for your business only, written approval is needed for any other usage.
13. Browser Compatibility
My designs are tested for cross-browser compatibility. They will display correctly in the most current versions of Safari, Mozilla Firefox, Google Chrome and Internet Explorer. I cannot guarantee your design will display properly in any outdated or future versions of any of the web browsers.
14. Client Responsibilities
It is your responsibility to backup your website before and after the installation process. I am not liable for any loss or damage to your blog or website content while installing your design, or any time after installation.
15. Support
15 days email support is included with each design. Design changes and/or website maintenance is not included and will be billed at $75/hr minimum one (1) hour.
16. Portfolio Use
I may add your website to my portfolio showing off your new design, and/or include a screenshot.
17. Fonts
I only use commercial-use fonts, purchased fonts, or open source fonts such as Google Web Fonts. Clients will be offered both free and paid fonts to choose from for type purposes on their site. Webfont licenses will be purchased at the client’s expense and added to the final bill. Clients who request a specific font that requires a commercial license will be asked to purchase that font and web font license at their expense.
18. Hosting
You understand hosting services are not included in the web design project. I recommended hosting with my preferred hosting providers Bluehost or RFE Hosting.
